Binoy Kodiyeri accepts fatherhood of Bihar woman's child but court denies couple's compromise plea

Mumbai: The Bombay High Court has refused to accept the plea to close the rape case against Binoy Kodiyeri.

The woman and Binoy had submitted a joint plea stating they have arrived at a 'consensus' to raise the child. They stated that the decision to withdraw the case was taken considering the future of the child.

However, the bench of justice Nitin Jamdar and justice NR Borkar said that a criminal case cannot be settled out of court. It reminded the pleaders that Binoy is accused in a rape case.

The latest plea admits that Binoy is father of the child. When the court asked if they got married, Binoy's advocate said they did not while the woman's counsel said they did. Assistant public prosecutor also backed the woman's advocate.

The court then said the confusion over marriage has to be settled first before considering the plea to compromise the case.

Binoy had earlier said that the rape case was fabricated. The DNA report submitted in the court is yet to be released. Binoy is the elder son of CPM Kerala state secretary and former minister Kodiyeri Balakrishnan.
