Vismaya Death: Adv B A Aloor appears for Kiran Kumar in court
Kollam: Sasthamcotta Judicial First Class Magistrate Court deferred the bail plea of accused Kiran Kumar in the death of Vismaya, to July 5. Criminal lawyer Adv BA Aloor appeared for the accused in court.
The court considered Kiran Kumar’s bail plea on Friday. Later, the court postponed the hearing to noon. Aloor read out the bail plea before the court.
He argued that Kiran Kumar is a popular official and was not named accused in any case before.
Police have been trying to trap him in a fake case. The police didn’t show such interest to nab the accused in similar suicide cases. They have been showing more interest in this case. It is only an offence under Section 498 A of the dowry prohibition act, argued Aloor.
But assistant public prosecutor (APP) Adv Kavya Nair opposed Aloor’s arguments.
At present, the accused is booked under Section 304 B for death due to torture over dowry. But as there is a mystery in the death, more sections would be added with the progress in the case, she argued.
Though the probe team received Kiran Kumar’s custody from the court, the investigation is not completed as he tested COVID positive. He will be taken into custody for evidence collection once he recovers from the disease. Hence, the Assistant Public Prosecutor appealed to the court to dismiss Kiran Kumar’s bail plea.
After hearing both parties, Magistrate A Hashim informed that the bail plea will be considered on July 5 again.
Kiran was sent to police custody for 3 days. He tested positive for COVID-19 on Wednesday evening. Following this, he was shifted to a special sub-jail in Neyyattinkara after producing him before the court.
With this, evidence collection at Vismaya’s residence was also interrupted. But the probe team collected maximum evidence against the accused within two days.
The police have been planning to seek his custody from the court once he tests negative.
Vismaya V Nair, a BAMS student, was found hanging inside the bathroom of her husband's residence on June 21. Her husband Kiran Kumar was arrested over suspected involvement in the death.
