NIA opposes Swapna’s bail plea in court, argues UAPA charges valid
Kochi: NIA team probing the gold smuggling case informed the special NIA court here that the UAPA charges invoked against the accused are valid. The probe team submitted a counter affidavit before the court opposing the bail plea of Swapna Suresh, accused in the case, on Tuesday.
“Gold smuggling affects the financial stability of the country. As per the amendment in Unlawful Activities (Prevention) Act, this offence also comes under the investigation. So UAPA charges will be valid in the case,” NIA pointed out in the counter affidavit.
The affidavit also noted that attaché in UAE consulate did not direct Swapana to contact the Customs officials.
"Swapna also created fake documents to prove the baggage carried food products. She frequently phoned the Customs officials to release the baggage,” NIA officials informed the court through the counter affidavit.
The affidavit also pointed out that the probe team uncovered deposits worth Rs 2 crore owned by accused Swapna Suresh and Sandeep Nair. NIA found that Sandeep had a bank deposit of Rs 55 lakh.
Sandeep’s bag was opened and examined before the court. Details of his bank deposits, US dollars and Omani rial were recovered from his bag.
NIA in the affidavit noted that the accused earned money through gold smuggling.
The probe team also informed the court that over 15 people were named as accused in the gold smuggling case. Details of these accused were submitted along with the affidavit.
The court will consider Swapna’s bail plea in the case under NIA on Thursday.
