The Kerala High Court feels that there should be a limit to the absurdity of police when persons are held for alleged sexual offence.
The Attingal police said that a woman and two men were found in a house that is alleged to be a brothel. They were booked under Suppression of Immoral Traffic and charge sheeted.
What was the offence? That is what the High Court wanted to know when the petition filed by the accused against the police came up for hearing at the court.
The police SI who investigated the case was of the view that he did not see any sexual exploitation or abuse. Even in the charge sheet it is only said that two men and a woman were making preparation for prostitution.
The High court then wanted to know what exactly is preparation for prostitution? For that the police had no convincing explanation.
It is a vacant or absurd statement conveying nothing. The court observed that the place was also not being used for the purpose of sexual exploitation. There has been no allegation that the house they were present has been branded as a brothel anytime.
In such circumstances the HC quashed the case in Attingal magistrate court.
