How can a qualified woman be denied job? asks HC
For the post of safety officer in a factory, a qualified woman cannot be denied job, the High Court ruled.
Engineering graduate Teresa Josephine had applied for the post of Safety Officer at Kerala Minerals and Metals. But as per the notification it was open only for male candidates because under Factories Act, women were not allowed night duty. Safety Officer duty is round the clock.
She challenged the notification as discriminatory. The Court observed that such a provision offends the rights of woman candidates. When the Constitution envisages equal opportunities for men and women, a qualified woman cannot be discriminated and excluded.
The court nullified the offending provision.
The court directed the factory management to consider her application and take decision without further delay. How can the factory management deny job to a fully qualified woman, Justice Anu Sivaraman asked.
The court noted that steps were already taken to amend the act but central government approval is awaited.
Women have already made their mark in many spheres of life, the Court noted.
