Bogus voting: Cancelling Seleena’s membership is complicated, says experts
Thiruvananthapuram: It is indicated that there are many technical complications in cancelling the membership of N. P. Seleena, an LDF member of the panchayat, who was found to have cast bogus vote at Pilathara in Kasaragod during Lok Sabha polls.
State Chief Electoral Officer Teeka Ram Meena had officially requested the State Election Commission to cancel Seleena’s membership after finding out that she cast bogus vote. The legal experts opined that there many complications to cancel the membership of Seleena.
The chief electoral officer had directed to charge criminal case against those who cast bogus votes. According to this, the collector who is also the returning officer, will file a complaint to the police and hand over the visuals of bogus voting as evidence.
The collector will ask in the complaint to charge case against those who cast bogus votes and the LDF agent at Pilathara AUP School who helped them.
However, Seleena's membership cannot be cancelled on the basis of filing a complaint in this regard, because being involved in a criminal case is not counted as sufficient reason for cancelling the membership. Also, Seleena can approach the high court in this matter if her membership is cancelled.
In another option, a voter in the ward represented by Seleena or another panchayat member can file a complaint to the State Election Commission. Even in that case, EC can take action only after completing the hearing and other procedures.
Also, if the court finds out that Seleena is guilty of casting bogus voting and pronounced the verdict, the EC can cancel her membership based on the verdict.
