HC comes down heavily on Kannur, Karuna MCs
Kochi: Taking strong note over the laxity on the part of the Kannur and Karuna Medical Colleges in MBBS admission, the Kerala High Court today asked the medical colleges to satisfy the cost ordered at Rs. 1 Lakh each.
The Division Bench comprising Justice P.R.Ramachandra Menon and Justice P.Somarajan stated that the lapses on the part of the medical colleges spoiled much time of the court, besides that of the Admission Supervisory Committee and the Government authorities including the Commissioner for Entrance Examinations, which should attract heavy cost. The court imposed a cost which should be paid within a month failing which, necessary actions will be taken against the medical colleges.
The HC, in the order, asked the ASC to re-examine the admissions made by the medical colleges to ensure inter se merit. The medical colleges were directed to submit all admission documents before the ASC on 31 October 2016. However, the HC approved the admission of 30 candidates at Karuna MC made by CEE during the spot admission.
On fee to be collected from the students, the HC said, "The Committee shall finalize the proceedings with regard to the regulation and fixation of annual fee payable by students concerned within a further period of three months."
"If the Committee finds that the Annual Fee finalized by the Committee is less than the fee stipulated in the Prospectus and collected from the students concerned, further course of action shall be provided, either to cause the excess to be refunded or set off against the annual fee payable for the future years," stated in the order.
The court further clarified that the admission made after the cut-off date is valid in rare situations. Quoting SC order in this regard, HC said, "the cut-off date cannot be used as a technical instrument or tool to deny admission to a meritorious students. The rule of merit stands completely defeated in the facts of the present case."
When contacted, the Chairman of ASC Justice J M James told Mathrubhumi Education Online, "Future course of action shall be taken after going through the full text of the HC order dated 28-10-2016."
