It is a suffocating job – a municipal worker who cleans drainages. The mud and filth is noxious. He may develop breathing troubles as he deals with hazardous materials. In such a situation, it is the duty of the Government to ensure complete safety for his work, ruled the Allahabad HC.
What are his rights as a worker?
He is a citizen doing hazardous work as he may not get any other work due to his sheer inability for various reasons. So the Government shall protect his rights. He has to get protective gears, insurance cover and other facilities for discharging his work. He is a citizen whose rights are protected. Here the Government shall ensure his welfare, the court ruled.
The Government shall prepare a pamphlet to be distributed to the public and give newspaper coverage as well start a website. The Government shall tell the worker of his rights. He has to be made aware of his rights. The court had taken suo moto action.
A separate wing shall be formed by the Government to oversee the care and protection initiated by the Government.
The participation of the contractors also should be ensured in this venture. The health of the worker is paramount, the Court said.
